WARRANTY & REPAIR POLICY

Clean Watercom ApS (“we”, “us”, “our”) warrants its products (“Product”) against defects in materials and workmanship when used normally in accordance with our published guidelines, which include but are not limited to the technical specifications, user manual, and service communications.

Warranty Period

The warranty period is three (3) years from the date of delivery to the end-user purchaser.

For resellers and distributors, the warranty period runs from the date of delivery from Clean Watercom ApS, not from the date of onward sale to the end-user.

Your Statutory Rights

This warranty is a commercial warranty that supplements your statutory rights. It does not limit or exclude any mandatory consumer rights you have under applicable law, including but not limited to rights under the Danish Sale of Goods Act (forbrugerkøbeloven) and EU Directive 2019/771. Those rights remain unaffected.

Conditions

This warranty applies only to:

– The original end-user purchaser.
– Products purchased through authorised online channels.
– Purchases accompanied by the original sales receipt or other proof of purchase.

What This Warranty Does Not Cover

Damage caused by misuse, unauthorised modification or repair, external causes (accident, fire, flood), normal wear and tear, or failure to follow the instructions in the user manual.

Making a Warranty Claim

If you experience a problem with the Product:

– If you purchased directly from Clean Watercom, contact us at vortexer.dk/contact.
– If you purchased from an authorised dealer, contact your dealer directly.

Include with your claim:

– A photo of the Product showing the issue.
– Your original receipt or proof of purchase.
– A description of the problem.

What We Will Do

If your claim is valid under this warranty, we will, at our discretion:

– Repair the Product using new or previously used genuine parts that have been tested and meet functional requirements, or
– Replace the Product with a product of the same model or, with your consent, a product with substantially similar features, or
– Refund the purchase price.

Return Shipping

We cover the cost of return shipping for all warranty claims within the 3-year warranty period.

Repair Options

Only Clean Watercom and its authorised resellers may perform service on the Products.

We offer repair service through the following options:

(i) Mail-in service. If your Product is eligible, we will provide prepaid waybills, packaging instructions, and the address for return. Once service is complete, we will return the Product to you. We pay for shipping both ways if you follow the packaging and shipping instructions.

(ii) DIY parts service. If available, we will ship a replacement part with installation instructions. We are not responsible for any labour costs you incur. If we require return of the replaced part, instructions will be included.

Note: If you repair the Product yourself and cause further damage, the warranty no longer covers the damaged parts.

Taxes and Duties

You are responsible for all taxes, duties, customs, and similar charges related to replacement parts or service, including international shipments. Where international service is available, we may repair or replace Products with parts that comply with local standards.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEAN WATERCOM APS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF REVENUE, LOSS OF PROFIT, OR DAMAGE TO PROPERTY.

THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR DEATH OR PERSONAL INJURY, LIABILITY FOR INTENTIONAL OR GROSSLY NEGLIGENT ACTS OR OMISSIONS, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

Governing Law and Jurisdiction

This warranty is governed by Danish law, excluding its conflict of laws principles.

Any dispute arising from this warranty shall be submitted to the courts of Denmark, with venue at the company’s registered address in Tørring. If you are a consumer, this does not affect your right to bring proceedings in the courts of your habitual residence under applicable EU law.

If we cannot resolve your complaint, you may bring the case to the Danish Consumer Complaints Board (Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark) or, if you are an EU consumer outside Denmark, the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

General

If any term of this warranty is held to be invalid or unenforceable, the remaining terms remain in full force and effect.

This warranty was originally drafted in English. If a translated version conflicts with the English version, the English version prevails.
